A 20-year-old man was arrested Friday night based on a Dec. 22 report from a woman who said he raped her in late September in an East Baton Rouge apartment after a night of drinking.
The man disputes her account, saying the sex was consensual.
The 18-year-old victim and a friend started off the night drinking vodka and orange juice in a car outside the friend’s apartment on Sept. 28, an East Baton Rouge Sheriff’s Office report says. Afterward, they joined others inside, including Devin Allen Kleinpeter, 20, and one other person. Later, another resident of the apartment dropped off the group of four at a local bar.
Friends of the victim told deputies all of them became extremely intoxicated because it was 50 cent night at the bar.
The victim told deputies she drank that night half a bottle of vodka, two Long Island ice teas, several lemon drop shots, several cranberry and vodkas, as well as two other drinks called “blue motorcycles,” the report says.
When the group returned to the apartment, around 2 a.m. they all smoked marijuana, friends of the victim told investigators. The victim threw up, and then her friend helped her take a shower.
The victim told deputies she fell asleep on the couch and woke up to Kleinpeter having sex with her. When the victim told him to get off of her and stop, Kleinpeter didn’t, the report says, and she then passed out.
When the victim woke up around 7 a.m., Kleinpeter was gone, she said in the police report.
Friends told deputies the last time they remember seeing Kleinpeter that night, he was sleeping on a chair near the couch.
Kleinpeter told detectives he drank beer, multiple shots and other mixed drinks that night, as well, but that he and the victim sat on the couch talking while everyone else went to sleep, the report says. Kleinpeter said he and the victim began kissing and that the two had consensual sex, adding that the victim never told him to stop.
Kleinpeter, 13261 Legacy Court, was booked into East Baton Rouge Parish Prison on third-degree rape.
