Psychiatrist testifies in 'very important day' in trial of Saints, Pelicans owner Tom Benson _lowres

A judge in San Antonio has set a Feb. 19 court date for settling the Texas trust fund battle between Saints and Pelicans owner Tom Benson and his daughter, Renee Benson.

Attorneys for both sides attended a status conference Friday in San Antonio and presented enough details of the agreement to satisfy Bexar County Probate Court Judge Tom Rickhoff that talks were proceeding appropriately, said Phillip Wittmann, an attorney for Tom Benson.

Wittmann, who did not attend the hearing, said it was just another step in the complicated process of resolving the dispute. The terms of the agreement are being kept confidential.

Renee Benson, the daughter of Tom Benson and his first wife, Shirley, is the beneficiary of the trust fund. She decided to sue her father for control of it last year after he revealed he had decided to cut her and her children out of his business empire.

The two sides agreed to a settlement on Jan. 22, three days before Tom Benson was due to be questioned by attorneys for his daughter, who has challenged her father’s mental competency in a separate lawsuit now pending in a Louisiana state appeals court.

The trust, which has been under the control of court-appointed third-party receivers since last year, has shares in a family-owned bank as well as car dealerships and real estate. It does not have any shares in Benson’s sports teams.

Renee Benson’s attorney could not be reached for comment.
