A retrial of former death row inmate Juan Smith in a rampage that killed five people in 1995 has been pushed back a week because of a personal matter involving one of Smith’s attorneys.

Orleans Parish Criminal District Court Judge Frank Marullo granted the delay Monday morning, postponing jury selection in the case until May 19.

Smith was convicted in the quintuple murder on North Roman Street in 1996, and the conviction was used by prosecutors to secure the death penalty in a triple murder on Morrison Road that occurred a month earlier.

The U.S. Supreme Court overturned the conviction on the Roman Street killings in 2012, finding that prosecutors had failed to turn over key evidence in the case to the defense.
