A Louisiana man was arrested last week in West Monroe, accused of disturbing the peace by cursing near a 75-year-old woman.

Jared Dylan Smith, 20, of West Monroe was booked April 8 with disturbing the peace through language and disorderly conduct, according to Ouachita Parish Sheriff's Office booking records.

The complainant said Smith was standing next to her when he yelled an expletive and "clearly disturbed her peace," the arresting deputy said in an affidavit of probable cause.

He said Smith denied yelling the expletive.

According to Louisiana law, one of the ways in which a person can be charged with disturbing the peace is by “addressing any offensive, derisive, or annoying words to any other person who is lawfully in any street, or other public place; or call him by any offensive or derisive name, or make any noise or exclamation in his presence and hearing with the intent to deride, offend, or annoy him, or to prevent him from pursuing his lawful business, occupation, or duty."

The penalty for disturbing the peace is up to 90 days in jail and a fine of up to $100.
